1. Agreement to these Terms

These Terms of Service (“Terms”) are a legal agreement between you and BF Fastigheter AB, Mejerivägen 21, 972 51 Luleå, Sweden (“BF Fastigheter AB,” “Orbyn VPN,” “we,” “us,” or “our”). They apply to the Orbyn VPN Android application, package com.orbyn.vpn, and related services (the “Service”).

By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service and uninstall the application. If you use the Service for an organization, you confirm that you have authority to accept these Terms for that organization.

2. What Orbyn VPN provides

Orbyn VPN's core purpose is to create a device-level encrypted tunnel between your Android device and a remote VPN endpoint. When active, eligible device traffic is routed through that tunnel until you disconnect, Android revokes permission, or the connection ends.

The Service may let you select from available VPN locations, view connection status, receive advertising, and access support or privacy controls. Features, locations, protocols, and capacity may change over time.

3. Eligibility

You must be legally able to enter into this agreement. The Service is not directed to children under 13. If you are below the age of legal majority where you live, you may use Orbyn VPN only with permission and supervision from a parent or legal guardian who accepts these Terms.

You may not use the Service if applicable law prohibits you from receiving or using VPN services.

4. Limited license

Subject to these Terms, BF Fastigheter AB grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Orbyn VPN on Android devices you own or control for lawful purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, attempt to extract source code, bypass technical protections, or create derivative works from the Service except where applicable law expressly allows and that right cannot be waived.

5. Android VPN permission and connection control

Orbyn VPN uses Android's VpnService API. The Service will ask for Android's VPN permission before establishing its first VPN connection. You may decline the request, but the core VPN feature cannot operate without that permission.

You control when to connect and disconnect. Android may display a key or VPN indicator while the tunnel is active. You can also revoke the VPN configuration through Android settings. We do not use VpnService to redirect or manipulate other apps' traffic for advertising monetization.

6. Acceptable use

You agree not to use, attempt to use, or help another person use the Service to:

• violate any applicable law, regulation, court order, sanctions rule, or legally binding restriction;
• infringe copyrights, trademarks, privacy rights, publicity rights, trade secrets, or other rights;
• distribute malware, ransomware, spyware, malicious code, or unsolicited bulk messages;
• attack, scan, disrupt, overload, or gain unauthorized access to any device, account, service, or network;
• engage in fraud, phishing, identity theft, harassment, exploitation, or threats;
• interfere with the Service, evade reasonable technical limits, resell access without written permission, or use automated methods that degrade capacity;
• conceal or facilitate criminal conduct; or
• violate the terms of a third-party service you access.

We may take proportionate steps to protect the Service and other users when we reasonably believe these rules have been violated.

7. Your responsibilities

You are responsible for your device, internet connection, the content you access or transmit, and compliance with local law. Keep your device and Orbyn VPN updated, review connection status before relying on the VPN, and disconnect when you no longer want traffic routed through the Service.

You are also responsible for any carrier data charges, roaming charges, taxes, or third-party fees associated with using the Service. VPN use may affect speed, latency, data consumption, battery life, or access to some websites and apps.

8. Advertising, purchases, and subscriptions

Orbyn VPN may display advertising. Advertising is delivered subject to your available consent and device choices and is also covered by our Privacy Policy.

If the Service offers a paid feature or subscription, the price, billing period, renewal terms, trial terms, and available cancellation method will be shown before purchase. Purchases made through Google Play are processed under Google Play's payment terms. You can manage or cancel a Google Play subscription through your Google Play account. Refunds are handled under applicable law and the policies shown at purchase.

Removing the app does not automatically cancel an active subscription.

9. Third-party services and content

The Service depends on third-party infrastructure and may link to or interoperate with Google Play, advertising providers, websites, and online services that we do not control. Their terms and privacy policies apply to your use of those services.

We do not endorse or take responsibility for third-party content, security, availability, or practices. A VPN location may not provide access to every website, app, stream, game, or region-specific service, and we do not promise that it will.

10. Privacy

Our Privacy Policy explains how the Service processes VPN network data, diagnostics, advertising data, and support communications. It also explains data retention, deletion, and your privacy rights. The Privacy Policy is incorporated into these Terms by reference.

11. Service availability and changes

We work to provide a reliable Service, but availability and performance can be affected by maintenance, capacity, device settings, network conditions, third-party failures, emergencies, or events outside our reasonable control.

We may add, remove, limit, or change features or server locations; install security updates; or discontinue all or part of the Service. Where reasonably possible, we will provide notice of a material discontinuation. We are not required to maintain a particular location, IP address, speed, protocol, or compatibility indefinitely.

12. Suspension and termination

You may stop using the Service at any time by disconnecting and uninstalling Orbyn VPN. Because the current Service does not require an account, there is no app account to close.

We may restrict or terminate access where reasonably necessary to address a serious or repeated violation of these Terms, protect users or infrastructure, comply with law, respond to a security risk, or discontinue the Service. Provisions that by their nature should survive termination—including intellectual-property, disclaimer, liability, and dispute provisions—will remain in effect.

13. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not warrant that the Service will always be uninterrupted, error-free, secure against every threat, compatible with every device or network, or suitable for a particular purpose.

We do not guarantee a specific connection speed, server location, public IP address, geographic result, anonymity level, or access to any third-party content. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, BF Fastigheter AB will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, data, or opportunities arising from or related to the Service.

Where liability cannot be excluded, our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid to us for the Service during the 12 months before the event giving rise to the claim or EUR 50. These limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that applicable law does not allow us to limit.

15. Governing law and disputes

These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles. Courts in Sweden will have jurisdiction, except that if you are a consumer, you may also have the right to bring a claim in the courts of your country of residence and to rely on mandatory consumer protections available there.

Before filing a claim, please contact us and give us a reasonable opportunity to resolve the issue informally. Nothing in this section limits your right to contact a consumer-protection authority or use another remedy that cannot be waived by contract.

16. Changes to these Terms

We may update these Terms to reflect changes in the Service, law, security needs, or business practices. We will revise the “Last updated” date and provide additional notice for material changes where required. Changes apply prospectively from their effective date. If you do not agree with updated Terms, stop using and uninstall the Service.

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a merger, acquisition, reorganization, or sale of the Service.
